These terms and conditions apply to the use of this Website and by accessing this Website and/or placing an order you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.

This site is run by Hines Designs. For the purposes of applicable data protection laws, including the EU General Data Protection Regulation (“GDPR”) (as amended or superseded) Hines Designs is the “controller” of the personal information collected through the site,email or by phone.

HOW DO WE COLLECT INFORMATION FROM YOU?

We may send an abandoned cart email to notify you of products left in your cart.
You have the option to unsubscribe from our e-mails through a link at the bottom of every e-mail we send to you. If you want to change the details that you have registered with us, or would like to amend your subscription preferences or unsubscribe altogether, this can be changed by contacting enquires@hinesdesigns.co.uk

HOW WE SHARE YOUR INFORMATION

We share your information with our core service providers and third party platforms as required for our business to function; for example, picking, packaging and processing orders, fulfilling deliveries, customer support, fraud detection, credit risk reduction checks, IT systems support, and internal audits.
If you choose to provide feedback on your transaction, we will share your information with an application for customer reviews. Your information may be processed by a third party in order to maintain the functionality of our site and database. In the event that you add items to your basket but do not complete a transaction, you may be sent an email. We will never swap your details with another company outside of the Hines group.
We also use services offered by Google, Facebook, Instagram and other similar social media platforms to better tailor our marketing communications and for targeted advertising. As part of this process, some personal information, such as your e-mail address, is provided to the relevant third party, however for security purposes this data is “hashed” prior to being shared. Hashing is a process of identity masking or “pseudonymisation” which means we do not disclose your e-mail but still enables linking between your social media presence and our Site. Your personal information will be transmitted to countries outside of the EEA, including the United States. We receive insights from Facebook about the effectiveness of our advertising campaigns which you experience on our site and social channels, helps to better target our advertising. Every external company we work with has a contract with us which clearly sets out our expectations and requirements in handling personal information and obligates them to meet these standards and those contained in the GDPR.

HOW LONG WE KEEP YOUR INFORMATION

We retain the information you provide for the following periods:
For as long as you subscribe to receive marketing information;
for as long as your account is being used and for a period of three years after the date you cease to use your account, after which period we will anonymise the personal information on file by deleting the personal information and allocating a personally unidentifiable unique reference ID and store the remaining information for a period of five years (“Data Retention Period”). After this time it will be permanently deleted from all systems and back-ups. If you wish to set up an account after this period this will be treated as a new account and your transaction history will not be available; in the case of any contact you may have with our Customer Care team for as long as is necessary to provide support-related reports and trend analysis. Our Data Retention Period has been determined to cover credit risk, fraud detection and customer service periods, as well as to cover regulatory requirements, and the resolution of disputes or fraud prevention.

HOW WE STORE YOUR INFORMATION

Your information may be processed by our staff or by the staff of our suppliers to the extent necessary to fulfil your order. By submitting your personal information to us, you agree to the transfer of your personal information, its storage and processing. We will keep the data which we collect from you on a secure server. Any information you give us relating to credit card details is handled by a PCI DSS compliant third party and encrypted using secure server technology. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access and require our suppliers to do the same.

Where we have given you a password (or where you have chosen one) to access certain parts of this site, you are responsible for keeping this password confidential. We ask that you do not share a password with anyone.

When entering any of our contests or prize draws, you provide your name, email address and mailing address. If you win, we will send the prize to the address entered and notify you by email. When you enter a contest or prize draw, you are also included in our newsletter list to receive notice of promotions, specials and new additions to the website . You may unsubscribe from this news list by following the unsubscribe instructions in any email received. PURCHASE OF PRODUCTS

Orders:
We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Contract creation and electronic contracting:
The technical steps required to create the contract between you and us are as follows:
You place the order for your products on the website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the website.
We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from Hines Designs. As your product is shipped we will send you a despatch confirmation email.
Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the product ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the relevant cancellation instructions.
Non-acceptance of an order may be a result of one of the following:
The product you ordered being unavailable from stock.
Our inability to obtain authorisation for your payment.
The identification of a pricing or product description error.
You not meeting the eligibility to order criteria set out in the main Terms & Conditions.

The contract will be executed and concluded in English.

Contract cancellation
Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right no longer than 14 days after the day on which you receive the products.

If you wish to exercise your right to cancel this contract after your order has already been despatched please follow the procedure set out in our returns procedure.

Please note that your right to return products does NOT apply to products which fall into the following categories unless they are faulty:
Goods made to your specification.
Any personalised goods.

Description of products:
Each product purchased is sold subject to its product description which sets out additional specific conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product description appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Severance:
If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver:
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival:
Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement:
These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what Hines Designs and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Law:
The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
